SSL Certificate Terms of Service Agreement

1. Introduction Welcome to Ness Web Solutions, LLC (“Company”, “we”, “our”, or “us”). By purchasing, using, or accessing our SSL Certificate services (“Services”), you, the Client, agree to comply with and be bound by these Terms of Service (“TOS”). Ness Web Solutions, LLC is not a direct seller of SSL Certificates, instead we are an authorized Reseller of SSL Certificates from our vendor.

2. Definitions

  • SSL Certificate: A digital certificate issued to secure online communications.
  • Client: The entity or individual who applies for and uses the SSL Certificate.
  • Vendor: The company we work with to provide SSL certificates.
  • Certification Authority (CA): The entity that issues and manages SSL Certificates.
  • Relying Party: Any party that relies on the SSL Certificate for secure transactions.

3. Eligibility & Use

  • You must provide accurate and complete information when applying for an SSL Certificate.
  • You must be at least 18 years of age in order to purchase the SSL Certificate.
  • The SSL Certificate must be used solely for lawful purposes and in compliance with all applicable laws and regulations.
  • You may not use the SSL Certificate for fraudulent, misleading, or malicious activities.

4. Certificate Issuance & Validation

  • The CA will verify your identity and domain ownership before issuing the SSL Certificate.
  • You agree to provide all necessary documentation and cooperate during the validation process.
  • The Company reserves the right to deny or revoke an SSL Certificate if fraudulent or incorrect information is provided.

5. Responsibilities & Obligations

  • You must ensure proper installation and maintenance of the SSL Certificate on your server.
  • You must safeguard your private key and not share it with unauthorized parties.
  • If your SSL Certificate is compromised, you must revoke it immediately and apply for a new one.

6. Term & Renewal

  • SSL Certificates are issued for a fixed term as specified at the time of purchase.
  • Renewal notifications will be sent before expiration, but it is your responsibility to renew the SSL Certificate in time.
  • Failure to renew may result in service interruption.

7. Revocation & Suspension

  • We reserve the right to revoke an SSL Certificate if:
    • If it becomes clear that the Client has provided incorrect information in order to obtain the SSL certificate;
    • If the Client has not paid the costs of obtaining the SSL certificate or have failed to do so within the specified period;
    • If Ness Web Solutions, LLC, our vendor and/or the Certificate Authority deem that the reliability of the SSL certificate has been compromised.
  • Revocation does not entitle you to a refund unless specified in our refund policy.

8. Limitation of Liability

  • The SSL Certificate is provided “as is” without any warranties, express or implied.
  • We are not liable for any damages resulting from the misuse, failure, or security breaches related to the SSL Certificate.
  • Our total liability under this TOS is limited to the amount paid for the SSL Certificate.

9. Refund Policy

  • There are no refunds unless the SSL Certificate is revoked or not issued due to the fault of Ness Web Solutions, LLC or our Vendor..

10. SSL Issuance Support

  • The client/customer is ultimately responsible for ensuring that the SSL certificate is issued.
  • Ness Web Solutions, LLC may provide assistance, but final responsibility for successful issuance lies with the client.

11. SSL Installation Service

  • SSL installation services are provided as a benefit to the client.
  • Ness Web Solutions, LLC is not responsible for any issues that may arise on the web server due to the installation of the SSL certificate.

12. Indemnification

  • You agree to indemnify and hold harmless Ness Web Solutions, LLC, our Vendor, and the Certificate Authority and affiliates from any claims, losses, or damages arising from misuse of the SSL Certificate.

13. Governing Law & Dispute Resolution

  • These TOS shall be governed by the laws of Jefferson County, Wisconsin..
  • Any disputes shall be resolved through arbitration or in the competent courts of Jefferson County, Wisconsin.

14. Modifications to the TOS

  • We reserve the right to update these TOS at any time.
  • Continued use of the Services constitutes acceptance of the updated terms.
