.GAY Domain Acceptable Use Policy

Effective: February 22, 2025

By using our services, you are agreeing to the following policy in addition to the General Domain Acceptable Use Policy & Terms of Service:

The .GAY Domain Acceptable Use Policy is an agreement between Ness Web Solutions, LLC, here as known by “Host” & GoDaddy Registry, here as known by “Registry”, and the client who purchased a .GAY domain, here as known by “Client” or “Registrant”. The “Host” will also be used to refer to its employees, agents, or representatives.

“Domain(s)” is referred to the .GAY domain registered through Ness Web Solutions, LLC

“Service(s)” is referred to the registration of .GAY domain names
“Agreement” refers to this document.

“Website” refers to the Client’s website

“Web Services” refers to the Client’s website(s) and email services.

By using our Services, the Client agrees to the following terms of service:

1. PURPOSE. The purpose of the additional agreement for all .GAY domains is to ensure Services using the .GAY domain are respectful and promotes goodwill towards all LGBTQIA+ individuals. Any hateful, homophobic, transphobic, or any other LGBTQIA+ hate, phobia, or intolerance, will be a direct violation of the Agreement. All recognized hate groups are banned from using .gay domains.

1.2. THE TREVOR PROJECT. If you or anyone you know is an LGBTQ+ person in crisis, The Trevor Project provides immediate crisis support 24/7/365 from anywhere in the US via their hotline at 1-866-488-7386, Text by texting ‘START’ to 678678, or from their TrevorChat on their website. The Trevor Project provides free and confidential services to LGBTQ+ individuals experiencing crisis or are struggling with coming out, LGBTQ+ identity, depression, and suicide. The Trevor Project is a non-profit agency supporting all LGBTQ+ individuals, and is confidential and not reporting to the National Suicide Prevention Lifeline.

1.3. NATIONAL SUICIDE PREVENTION LIFELINE. If you or anyone you know is in crisis please call the 24 hour National Crisis Hotline at 1-800-273-8255, or call 988, or text HOME to 741741. The National Suicide Prevention Lifeline/Hotline provides free and confidential support to all people in emotional distress 24/7/365 across the United States.

2. CONTENT. The Client represents that it is the owner or valid licensee of all data or content it will upload in connection with the Services (collectively, the “Content“) and that it has secured all necessary licenses, consents, permissions, waivers, and releases for the use of the Content.

SECTION 3 OF THIS AGREEMENT IS COPYRIGHT 2023 GoDaddy Registry; All Rights Reserved. In the following section, the term “Registry” also encompasses the Host as well. Violation of the following part will result in sanctions from not only the Registry of GoDaddy Registry but also the Host of Ness Web Solutions, LLC. Violation of the following part will result in violations from the Registry and Host, both, and not from one or the other. All violations from the following portion found from the Host will additionally be reported to the Registry. Section 3 of this Agreement comes directly from the .GAY Community Protection Policy.

3.1. RIGHTS PROTECTION POLICY. The .gay Rights Protections Policy exists to establish .gay as a gay-friendly Internet space. This policy exists to discourage homophobic, anti-LGBTQIA+ usage and provide specific remedies for domain names that intentionally use .gay to malign or harm LGBTQIA+ individuals or groups. While we are unable to monitor all content hosted on .gay domain names in real time for compliance, we will accept and investigate complaints in accordance with this policy. The Registry reserves the right to update the policy and refer cases to partner organizations for external adjudication. Pursuant to this policy the Registry may suspend, place on serverHold, revoke, or cancel registrations at its sole discretion. The Registry may request content be removed by the registrant via the sponsoring Registrar or web host.


3.2. PROHIBITED BEHAVIORS. The following behaviors are prohibited on .gay domains:

  1. Inciting or promoting violence against LGBTQIA+ persons;
  2. Bullying, engaging in cyber bullying or inciting others to bully;
  3. Harassing, or encouraging others to harass or harm others;
  4. Stalking;
  5. Abusive intent to cause fear or threaten violence;
  6. Hate speech;
  7. Or Activity intended to organize, coordinate, or otherwise enable one of the above.

3.3. ADDITIONAL PROHIBITATIONS. Additionally, registrations are prohibited to parties that are, or are associated with, recognized hate groups. Domains with forum websites must have enforcement policies and capabilities to respond to contributor behavior that violates the above. The Registry reserves the right not to respond to claims made in bad faith. While the Registry is dedicated to enforcing its policy and follow up to complaints in a timely manner, the Registry is not responsible for registrants’ content, and therefore cannot guarantee that .gay websites will be free from content that violates its policies. Failure to enforce this policy or respond to a complaint does not constitute a waiver of our right to enforce it; nor does this policy create any obligations to users or any third-party beneficiary rights or private rights of action.

4. NATURE OF CONTENT: The Client shall additionally abide by all policies set forth in Domain Services Acceptable Use Policy & Terms of Service Policy.

5.1. FEES FOR VIOLATIONS. If the Client violates this agreement, they will typically have 24 hours to cure the violation. If they do not cure the violation within the allotted time, the website hosting and other services will be suspended until the violation is cleared up by the Host and the Client will be billed at $200/hour worked, billed in 15 minute increments, or the Host may terminate the Client’s account or Service without refund and/or at regular billing for that time period. The Client is responsible for all fees assessed by the Host for violating this Agreement.

5.2. FEES PASSED ALONG. If the Host is assessed any fee by any service partner, agency, or governmental entity, or other source for the content of the Clients website or for violating any 3rd party service agreement as listed above, the Client will be responsible for those fees.

5.3. FEE AMOUNTS. The Client will be charged the exact fees charged to the Host, along with a Host fee for the violation of $200.00 per violation.

6. CHANGES TO THIS STATEMENT. Ness Web Solutions, LLC reserves the right to change this Terms of Service/Acceptable Use Policy from time to time. We will notify about significant changes to this policy by sending a notice to the primary email address specified in your account 30-days prior to the changes affecting you account. Your continued use of our services after such modifications will constitute your: (a) acknowledgment of the modified Terms of Service/Acceptable Use Policy; and (b) agreement to abide and be bound by that Terms of Service/Acceptable Use Policy.
